San Jose Police Officer Accused of Rape While on Duty Fired

A San Jose police officer accused of raping a woman while on duty two years ago has been fired.

A San Jose police spokesperson confirmed to NBC Bay Area that 40-year-old Geoffrey Graves was fired Wednesday.

Graves had been on paid administrative leave since his arrest, and the department did not say why he was fired or give any other details, citing privacy restrictions on personnel issues.

Graves' attorney said the move was premature before he has been proven guilty of the charges. Graves has pleaded not guilty.

Graves is accused of raping the woman in September 2013 after responding to a family disturbance call at her home. Prosecutors say police determined the woman and her husband had been drinking, but no crime had occurred.
