Family of 19-Year-Old Files Wrongful Death Suit Against Pleasanton Police

The family of a 19-year-old San Jose man, shot and killed by a Pleasanton police officer,  filed on Monday a federal lawsuit against the department.

Police say John Deming Jr. broke into a classic car dealership, started jumping on cars, and then attacked the officer.

A seven-month investigation found the officer was acting in self defense on July 5.

The lawsuit claims filed by high-profile Geragos & Geragos said the the unarmed teen, who was also the son of a reserve officer, was shot multiple times and murdered by an unstable officer. It also states that officer was going through pre-existing emotional stress and shouldn't have been on patrol.

He has since been relieved of his duties.
