Chatting on the cell became a dangerous situation for a San Jose man.

Police say the 53-year-old Hispanic man was talking in Spanish near Saratoga and Latimer Avenues around lunchtime yesterday.

Before he knew what was happening, another man was attacking him.

Police say the culprit is 28-year-old San Jose resident Scott Pontzious. He is white.

Pontzious allegedly told the victim that he needed to learn to speak English.

He then ran off, but police arrested him not too far from the scene.

He was booked into the Santa Clara County jail on suspicion of battery and committing a hate  crime.
