The legal troubles of a former BART officer convicted of killing an unarmed man on a train platform will begin again.
Johannes Mehserle, who was released after serving two years for the involuntary manslaughter death of Oscar Grant, is expected to testify in his defense in a civil case where he is accused of abusing another BART rider.
Kenneth Carrethers says Mehserle beat him during an altercation with BART officers at the Coliseum/Oakland Airport Station on Nov. 15, 2008, according to SF Gate.
The 43-year-old is seeking damages against a group of five BART officers, including Mehserle, reportedly involved in the incident that left him with facial bruises and a sore shoulder.
BART is expected to fight on behalf of Mehserle and show that Carrethers was a threat to the agency's officers.
Mehserle is expected to testify that he was acting to protect a fellow officer, in his own defense.
Jury selection is set to begin Monday and opening statements could be heard a day later.
