City leaders voted to appeal to the U.S. Supreme Court its antitrust lawsuit against Major League Baseball that seeks to allow the Oakland Athletics to move to San Jose.
The San Jose Mercury News reports that on Tuesday the City Council voted unanimously to appeal.
It remains unclear whether the high court will take up the case.
Last month, a three-judge panel of the 9th U.S. Circuit Court of Appeals ruled unanimously that the claims were barred by baseball's antitrust exemption, established by the U.S. Supreme Court in 1922 and upheld in 1953 and 1972.
The A's have been unable to move to San Jose because of objections from the San Francisco Giants, which have territorial rights over Santa Clara County.
San Jose sued MLB in June 2013 for conspiring to block the relocation.
