Police in Palm Springs said they shot and killed 22-year-old U.S. Marine Cpl. Allan Devillena early Saturday morning.

Police said the incident started when two bicycle officers heard loud voices inside a parking garage. They went inside and recognized Devillena and his friend from an earlier drunk in public stop.

Devillena was in the drivers seat and officers told him to turn off the car, but they said he turned the car around. The San Jose man kept driving when an officer leaned in a window to turn the car off, and they said he hit another officer and that is when police fired.

Devillena was killed but his friend is not hurt. The Chief of Police in Palm Springs said it's a tragedy for everyone involved.

Devillena's family is driving to Palm Springs looking for answers. His family said the 22-year-old recently returned from Afghanistan and was weeks away from ending his service with the Marines.

His family also said  he planned to go to college and study sound engineering.

His father told our sister station in Palm Springs Devillena was a good guy and would not start something with police. He said he did not have it in him.
