Police Make Arrest in Shooting Death of San Jose State Nursing Student

San Jose police have made an arrest in the killing of a 19-year-old nursing student who was shot to death while sitting in the passenger seat of a car downtown.

Police arrested 23-year-old Johnny Lozano after 5 p.m. Wednesday in San Jose for violating his parole by carrying a loaded weapon. After the arresting officer checked the description of the shooter, Lozano was charged in the killing.

Police are not saying what Lozano's involvement is, but they confirm he was at the scene early Saturday morning. The gun found on Lozano has not been connected to the homicide. Investigators plan to conduct ballistics tests on the weapon.

Lozano remained in police custody Thursday evening.

Kimberly Chico was a student at San Jose State University slated to return to classes later this month, a spokeswoman said Monday.

Chico was shot at about 1:20 a.m. Saturday in the area of South Second and East San Salvador streets, police Sgt. Jason Dwyer said.

Dwyer said Thursday that Chico was "in the wrong place at the wrong time" when she was shot.

"At this point, we've determined that she was a completely innocent victim," Dwyer said. "She happened to be an occupant in a vehicle that was driving by when literally bullets were flying through the air."

The driver of the car carrying Chico was not hit and called 911, police said.

Chico was transported to Regional Medical Center where she was pronounced dead, Dwyer said.

Chico’s family told NBC Bay Area that Chico was out with her friend celebrating their last night together before her friend went back to San Diego for school. When the car they were in drove up to the intersection of San Salvador and Second, that's when shots were fired and one of the bullets went into the car, striking Chico.

The homicide marked the city's 30th of 2013.
