San Jose Considers Tougher Rules on Medical Marijuana Dispensaries

Mayor floats plan to restrict cannabis to 1 percent of San Jose

There's simply too much medical marijuana in San Jose for Mayor Chuck Reed's liking.

Therefore, the mayor is proposing new rules for where the city's medical marijuana dispensaries can go, according to the San Jose Mercury News: to wit, about 1 percent of the city, or about 1,400 parcels.

That's what would be left for medical cannabis if dispensaries were banned within 1,000 feet of a school, 150 feet of a home, and 500 feet from drug rehab centers.

State law forbids a pot club from operating within 600 feet from a school. Tougher San Jose rules would add churches, parks, libraries and community centers to that list -- and make the barrier 1,000 feet.

Medical marijuana supporters say those rules are too tough, and vow to fight them -- just as they did a proposal in 2011 that would have restricted the number of dispensaries in town to 10.
