San Jose Lawyer Changes Story About Client

A defense attorney who told a Santa Clara County judge he was assaulted by his own client is changing his story with the client now on trial on new charges.

The San Jose Mercury News reported on Wednesday that attorney Andy Tursi made the complaint against his client, Ernesto Mirabal, about 2 and half years ago. According to court records, Tursi told the judge Mirabal slammed his head into a jail wall and threatened to ``do him.''
 
Mirabal at the time was on trial on suspicion of trying to hire a gang member to prevent a teen witness from testifying against him.

The judge declared a mistrial after hearing Tursi's complaint.

Mirabal is now on trial on charges of making a criminal threat against Tursi. But Tursi says the confrontation was no big deal and has downplayed the encounter.
