A Santa Clara County grand jury has indicted former San Francisco 49ers lineman Ray McDonald on one count of rape of an intoxicated person.
The indictment stems from a Dec. 15, 2014 incident at McDonald's home.
The district attorney's office has also charged 49ers linebacker Ahmad Brooks with misdemeanor sexual battery. Authorities said the separate assaults occurred the same night against the same victim.
49ers General Manager Trent Baalke said on Wednesday that Brooks will not participate in Saturday's game against the Denver Broncos.
“The organization is aware that a misdemeanor charge has been filed against Ahmad Brooks stemming from a December 2014 matter," Baalke said in a statement. "We take any charge against a member of this organization seriously and are in communication with the NFL."
McDonald is scheduled to be arraigned on Sept. 25 at the Hall of Justice in San Jose and faces a maximum of eight years in prison. Brooks faces a maximum of six months in jail and will be arraigned at a later date, officials said.
The grand jury also indicted McDonald for a May 27 violation of the court’s domestic violence restraining order, which carries a maximum sentence of one year in jail.
The grand jury declined to indict McDonald on felony false imprisonment and other domestic violence misdemeanor charges stemming from a May 25 incident with another woman. The district attorney's office stated it plans to dismiss that criminal complaint.
