Castro Valley Man Shot While Pointing Fake Gun Dies

Authorities say 49-year-old man who was shot by an Alameda County sheriff's sergeant after he allegedly pointed a fake gun at deputies has died.
 
 Sgt. J.D. Nelson says Terrence Barry died Sunday at a local hospital two days after deputies were called to his Castro Valley home by family members.
 
Nelson said it appears that Barry intentionally provoked the sergeant to shoot him as Barry said he would shoot it out with deputies.
 
When an armored sheriff's vehicle arrived, authorities say a sergeant stationed at a porthole on the vehicle opened fire when Barry pointed what appeared to be a gun.
 
It was later determined the weapon was a fake wooden gun.
 
Nelson said Barry was on probation for weapons charges. The sergeant has been placed on standard paid leave.
 
The case remains under investigation.
