Man Claiming to Have “Bombs” in Gilroy Surrenders

Gilroy police evacuated an apartment complex on Thursday morning after a man claimed he had a bomb and firearms at an apartment complex and then barricaded himself inside.

Police took the man - identified as Daniel Wheatley, 32, - into custody just before 5 p.m. Police said he ended up not having a bomb.

The surrender capped all an-day event. Police had surrounded the Cypress Pointe Apartments in the 8200 block of Kern Avenue starting at 10 a.m., trying to get Wheatley to come outside.

The apartment was evacuated and residents were taken by bus to a senior center nearby, police said. Gilroy police were being assisted by the Santa Clara county Bomb Squad, SWAT Officers, Morgan Hill police and a hostage negotiator.

 The apartment complex is set in an upper middle class neighborhood and includes a swimming pool and manicured lawns.

Nearby Rod Kelley Elementary School was placed on lockdown as a precaution.

Traffic was blocked on Kern Avenue between Welburn Avenue and First  Street, and a two-block area around the scene was cordoned off.
