During a break in the ethics commission hearing about the future of his job, suspended sheriff Ross Mirkarimi calls the case against him smeared and sensationalism.

The meeting focused on what will be allowed as evidence in his official misconduct hearing.

One sticking point is the written declaration from Mirkarimi's neighbor and friend, Ivory Madison.

Mirkarimi's attorneys say it shouldn't be allowed.

There were so many objections, commissioners asked for them in writing and are considering subpoenaing Madison to testify.

Ivory Madison took the video of Mirkarimi's wife, Eliana Lopez, tearfully showing a bruise on her arm that she says Mirkarimi caused.

Mirkarimi plead guilty to false imprisonment in connection with the domestic violence incident.

Mayor Ed Lee suspended the sheriff and now wants him removed from office. Mirkarimi admits he grabbed his wife during a New Year's Eve argument outside their home.

He says the fight ended there, but in her declaration, Madison says, "Eliana told me that the verbal abuse continued in the house, and escalated to physical abuse, and that both went on for some time."

Commissioners will decide next week if those statements will be allowed.
