Eliana Lopez Will Take Stand in Domestic Violence Trial

San Francisco Sheriff Ross Mirkarimi's wife will testify at her husband's upcoming trial.

The San Francisco Chronicle reports Eliana Lopez will cooperate and take the stand.

Lopez has repeatedly denounced the misdemeanor domestic violence charges against her husband and has refused to talk to investigators.

Her attorney, Paula Canny, said how much she says in the trial will depend on whether the district attorney grants her immunity.

Canny fears if Lopez testifies without immunity, and says for example that she and her husband did have a loud, physical fight with their son there, she could be charged with child endangerment.

Canny also wants to protect Lopez from any attempts by federal authorities to send her back to her native Venezuela.

Prosecutors say Mirkarimi bruised his wife's arm during an argument in their home New Year's eve.
