As Recount Looms, Cupertino Swears in New City Council

Cupertino already has sworn in a new City Council and a new mayor, even though there's a recall underway for one of the council seats.

The top three vote getters win seats on the Cupertino City Council, and only 45 votes separated the third- and fourth-place candidates in the November election. That narrow margin triggered an automatic recount by the Santa Clara County Registrar of Voters.

But as the recount was underway, the city went ahead and swore in the initial top three, and that council elected a new mayor, which could present a problem if the recount changes the result of a council race.

"It makes a difference in who’s going to finally lead the city," resident Guru Betta said "I think that should be considered."

Officials with the registrar’s office told NBC Bay Area they don’t believe the recount will change anything. They've actually finished recounting the votes, and they're now waiting for county leaders to finish auditing the new numbers.
