One man was killed and another was injured on Thursday evening in a shooting near Capitol Park in East San Jose, according to the San Jose Police Department.
The death marks the city's 41st this year, compared to 30 at the same time last year.
Officers arrived at the scene near Goss Elementary School about 6:30 p.m. and discovered two men suffering from at least one gunshot wound each. One of them was pronounced dead at the scene, police said. The second was taken to the hospital and treated for non-life-threatening injuries, police said.

Homicide investigators closed off the whimsically named Bambi, Peter Pan and Van Winkle lanes, and residents were being escorted out of the area, according to witnesses.
The identities of the victims were not released pending confirmation by the Santa Clara County Coroner’s Office and notification of next of kin.
