San Jose police began investigating the city's first homicide of the year early Thursday after they found a man shot in someone's driveway in the eastern part of the city.
The man was laying in the 1600 block of E. San Antonio Street for about 45 to 50 minutes, police said, before a passerby called 911.
UPDATE: Police on Friday confirmed the identity of the victim as Juan Rios Sanchez, 36, of San Jose.
The first emergency call came in at 1:26 a.m. A woman had discovered the man lying in her driveway, and her mother told NBC Bay Area on Thursday that she had warned her daughter about the dangers of living in this neighborhood.

Martin Hernandez looked outside about 12:45 a.m. when he heard gunfire. Two bullets even lodged in the outside fence of his home. But Hernandez told NBC Bay Area on Thursday morning that he missed seeing the man, who was shot and lying below in the dirt near his driveway.
Eventually, the victim was taken to a local area hospital where he was pronounced deceased a short time later.
Police have no motive and no suspects.
In 2013, the city recorded 44 homicides, all in the first 11 months of the year, the Mercury News reported. The deaths include a killing investigated by San Jose State University police that the San Jose Police Department does not count toward its total.
That follows 46 homicides in 2012 and 42 in 2011.
