The Morgan Hill Unified School District is being sued by one of the victims molested by a fifth-grade teacher.
Attorney Robert Allard, who filed the suit on behalf of the victim, said Paradise Valley Elementary School failed to recognize obvious predatory behavior.
"Well when you walk by a classroom and the windows are blocked and the teacher is in there with a child, and the door is locked, wouldn't you ask yourself why is he doing that?" Allard said.
In a complaint for damages filed Wednesday in Santa Clara County Superior Court, the victim claims negligence and breach of mandatory duty against the district.
In October, a former teacher at the school was sentenced to 40 years in prison after he plead guilty to molesting fifth-grade girls.
John Loyd, 53, admitted to molesting four girls, mostly in 2012 and 2015. He had been a fifth-grade teacher at Paradise Valley Elementary School, until he was arrested in October 2014.
Many of the victims' parents now want teachers and school administrators to take mandatory predatory identification training, or PIT, to help spot predators before they can act.

Allard said he hopes Sen. Jim Beall, D-San Jose, will sponsor the bill because the problem of predators in schools will not go away.
"Pedophiles go to where the kids are. It's not rocket science," Allard said. "They're not accountants sitting behind a desk. They go to schools. They go to daycares. They go to sporting programs."
