Wal-Mart is giving up on building a new store in Hercules.
After buying a tract of land in 2005, the retailing giant had wanted to build a big-box store on the property.
But Wal-Mart's plans resulted a lengthy legal battle with the city and residents.
Even though Wal-Mart won the latest legal round in 2007, it never filed an application with Hercules again.
A Wal-Mart spokesman says the company dropped plans to build in Hercules because of "a number of factors." The retailer operates stores in nearby Richmond and Martinez.
Meanwhile, the Concord City Council has approved what will be known as the Lowes shopping center near Highway 4.
A 24-hour Wal-Mart had been planned for the property, but the council had initially rejected the project.
