It's never a good idea to have your hand on your cell phone while driving in California - it's against the law. But there soon could be even more reason for you not to get caught, according the the San Jose Mercury News.
State Sen. Joe Simitian (D-11th) is pushing a plan to make it a moving violation the second time a driver is caught holding a cell phone or texting while behind the wheel. A moving violation adds points to your record and ultimately lead to higher insurance rates.
The first offense would be a fine. Simitian's bill would increase that fine to more than $300.
