Defense Pushes For Mistrial in Killing of Vallejo Police Officer

The family of a Vallejo police officer killed in the line of duty is hoping for closure this week.

Nearly four years after Officer Jim Capoot was shot and killed while chasing a suspected bank robber, a jury is deliberating in the case, but the case has hit some very big bumps.

Suspect Henry Smith's family insists the court's trying the wrong guy. Prosecutors claim Smith shot and killed Capoot as he chased the suspected bank robber in 2011. The jury has been deliberating all week, and now, four jurors have come forward claiming the jury's only African-American male juror is biased against police.

In a highly unusual move the judge questioned the juror and then quizzed four of his colleagues about the man's conduct. The juror insists he does not feel all police are corrupt.

While the defense is pushing for a mistrial, the police officer's loved ones are hoping and waiting for justice.
