Jury: SJ Driver With Brain Cyst Guilty of Murder

A drunken driver who killed two pedestrians in San Jose and blamed a swollen brain cyst for the accident has been convicted of murder and assault.

Santa Clara County prosecutors say 49-year-old Armando Ochoa is facing 40 years to life in prison.

Ochoa had a blood-alcohol level three times the legal limit when his SUV struck three people in 2008.

Prosecutors say Ochoa racked up 10 speeding tickets and four drunken driving convictions by the time he killed 71-year-old Aproniano Siruno and 67-year-old Rodolfo Escurial and severely injured 73-year-old Esteban Casiano.

Defense lawyer Ingo Brauer told jurors a cyst on his client's brain was to blame.

The San Jose Mercury News says the jury on Tuesday convicted Ochoa of two counts of murder and one count of assault with a deadly weapon.
