Landlord Asks Feds To Kick Out Famous Pot Club

The San Jose location of Harborside Health Center may be in trouble.

The landlord's not on Harborside Health Center's side.

The beleaguered medical cannabis dispensary, California's largest, is the target of a federal Justice Department lawsuit seeking to shut down its two locations, in Oakland and San Jose. And in at least San Jose, the landlord wants the dispensary shut down, too, according to Courthouse News.

Concourse Business Center, which rents to Harborside commercial space on Ringwood Avenue in San Jose, asked a federal judge on Wednesday to issue an order barring the use of the property for the "distribution of marijuana in any form," according to the news service.

Harborside is a famous dispensary: it was the subject of a documentary, "Weed Wars," and it has more than 100,000 members, according to reports. The motion does not involve the Oakland location.

United States Attorney Melinda Haag filed in July actions to seize the properties via an asset forfeiture. After the forfeiture actions, Concourse tried to get Harborside to vacate the property, but the dispensary refused, according to reports.

Concourse filed a 30-day notice to get the dispensary to stop operating, but it was not obeyed, according to reports.

Harborside has said that the clinic has "nothing to be ashamed of," and vowed to fight the federal government -- and now its landlord -- in court.
