Foster City Man Faces Jail time after attack

A Foster City man is facing a nine-month jail sentence for hitting his elderly father in the head with a hammer.

Authorities say 58-year-old Jayantibhai Patel struck his father twice because he thought the 81-year-old had to be hospitalized before a nursing home would accept him.

Patel was originally charged with attempted murder in the October 2007 incident. He could have faced up to five years in state prison after pleading no contest in August to elder abuse.

According to a police report, Patel said he wanted to hurt his father only "a little bit." Police said the father needed seven staples to close two head wounds.

A San Mateo County Superior Court judge also ordered Patel to attend domestic counseling for a year. Patel will begin his sentence in January.
