San Jose's lawsuit against Major League Baseball, which has blocked a potential move by the Oakland A's to northern California's largest city, is alive in a federal appeals court, the San Jose Mercury News reported.
A judge last year dismissed San Jose's arguments that MLB is breaking ages-old antitrust restrictions in holding a monopoly on pro baseball, the newspaper reported.
Attorneys for San Jose are asking a federal appeals court to eliminate MLB's antitrust exemption and stop stalling a legal argument in an open courtroom over the A's move.
That could begin in May. MLB is expected to prepare counter-arguments, the newspaper reported.
